GDPR Compliance & Data Rights
1. Introduction
At Staivo — Landlord Property Services, we are committed to the highest standards of data protection. As we provide luxury accommodations in Europe (France) and across the globe, we comply with the EU General Data Protection Regulation (GDPR). This document outlines the rights of European citizens and our global commitment to data integrity.
2. Data Controller
The data controller for your personal information is: Staivo – Landlord Property Service ABN: 80 952 426 821 P.O. Box 604, Donovan St, Lalor VIC 3075, Australia. Data Protection Officer: help@staivo.com
3. Lawful Basis for Processing
We process your data under the following legal bases:
Contractual Necessity: To manage your booking, secure your accommodation, and facilitate bank-to-bank settlements.
Legal Obligation: To comply with international “Know Your Customer” (KYC) laws and local reporting requirements for short-stay guests in regions like France and the Philippines.
Legitimate Interests: To protect our properties from fraud and ensure the safety of our hosts and guests.
4. The “Privacy by Design” Advantage
Because Staivo operates a direct bank transfer model, we achieve “Data Minimization” by design:
No Financial Profiling: We do not collect or store credit card numbers, CVV codes, or card expiration dates.
Reduced Risk: By removing the most sensitive financial data from our ecosystem, your risk of digital identity theft is significantly lower than on traditional booking platforms.
5. What Data We Collect & Why
Identity Verification: We require a government-issued ID to verify guests. This is a legal requirement in many EU jurisdictions to prevent unauthorized subletting and fraud.
Contact Information: Email and phone numbers for 24/7 Guest Relations and secure check-in instructions.
Financial Records: Records of bank transfers are maintained for tax compliance and to manage the 6-Day Secure Bridge refund protocol.
6. International Data Transfers
As an Australian-managed agency, your data may be transferred to and stored in Australia. We ensure that these transfers are protected by Standard Contractual Clauses (SCCs) approved by the European Commission, ensuring your data receives the same level of protection as it would within the EU.
7. Your European Data Rights
Under the GDPR, you have the following rights:
The Right to Access: You may request a copy of the personal data we hold.
The Right to Rectification: You may request that we correct any inaccurate information.
The Right to Erasure: You may request that we delete your data (“The Right to be Forgotten”), provided there is no overriding legal or financial obligation to retain it (e.g., pending bank refunds).
The Right to Data Portability: You may request that we transfer your data to another service provider.
The Right to Object: You may object to the processing of your data for marketing purposes.
8. Data Retention
We retain personal information only for as long as necessary to fulfill the booking contract and comply with statutory financial record-keeping periods (typically 7 years under Australian and European tax laws).
9. Security of Processing
We employ industry-standard encryption and access controls. Access to your personal data is strictly limited to authorized LPS employees and vetted local partners (e.g., check-in managers) who require the information to facilitate your stay.
10. Lodging a Complaint
If you believe your data has been handled incorrectly, you have the right to lodge a complaint with your local Data Protection Authority (e.g., the CNIL in France) or the Office of the Australian Information Commissioner (OAIC).
